If your choose to get married in the United States, you will need a K1 Fiance Visa

What is a K1 Fiance Visa?

A Fiancee Visa (also known as a K1 Fiance Visa) is a travel document that allows a foreign Fiancee of a U.S. Citizen to enter the United States for the sole purpose of getting married. Fiancée Visas are generally considered the quickest vehicle to legally bring a foreign fiancée to the U.S. with the intentions of marriage and immigration.


What are the qualification requirements for a K1 Fiance Visa?
In order to qualify for a K1 Fiance Visa, you must meet the following main requirements:

  • You are a US citizen
  • You have met your fiancee within the previous two years
  • You and your fiancee are both legally free to marry
  • You and your fiancee both have a serious intention to marry within 90 days of your fiancee’s arrival in America.
  • You earn a sufficient income to support your fiancé (best to show at least 125% above of US Poverty Level for your size family or you will need a co-sponsor)

 

Who is eligible to file a Petition for a K1 Fiance Visa?

The U.S. Citizen who intends to marry a foreign national in the United States, or his / her legal counsel, must file the Petition. The U.S. Citizen and foreign fiancee must be free to marry. This means that they are both unmarried, or that any previous marriages have ended in divorce, death, or annulment. The couple must also have met in person (at least once) within the last two years prior to the filing of the Petition. Sometimes and only in extraordinary circumstances (religious or hardship cases) will a Fiancée Visa be issued to a couple who have not met as required.

How long does it take to get approval of the K1 Fiance Visa Petition?

Generally speaking, without the assistance of our office, we have heard that the process can take up to 12 months. With the help of our firm, we believe that the processing time will be greatly improved. Our cases have generally been approved within 4- 5 months. Now that’s fast!
Once we have received your contact information questionnaire filled out in its entirety and all supporting documents, we will file your petition within 48 hours of receipt. In most cases, we will use email to communicate with you. If you do not use or have access to email, we will advise you of the fastest form of mail delivery.
After getting your approval, your Petition is forwarded to the US Embassy in Manila for continued processing overseas.
Once your Petition has been received by the US Embassy in Manila, you will receive a letter advising you to proceed with the final forms and paperwork. Again, our office will prepare all the necessary forms for you. You can expect to wait between 3 to 4 weeks for your letter and then another 30 days or so before you are granted your interview and your visa.
 

If You choose to get married in the Philippines, you will need a K3 Spousal Visa

What is a K3 Spousal Visa?

A K-3 Visa is a travel document that allows the spouse of a U.S. Citizen (not a U.S. Resident), who has an I-130 Immigration Visa Petition pending, to enter the United States prior to USCIS approval of the I-130 Petition. The K-3 Visa was created by the U.S. to create a way to allow spouses to enter the U.S. while they waited for the U.S. Citizen Petition to be approved.

What are the qualification requirements for a K3 Spousal Visa?
In order to qualify for a K3 Spousal Visa, you must meet the following main requirements:

  • You are a US citizen
  • You are legally married to your Filipino or Filipina spouse
